In contrast, the common law trial by jury constitution expressed in Magna Carta 1215 requires a jury of social equals to confront reality as it actually occurred, rather than fit the accused into a predetermined template. The accused is their social equal, so the question of their guilt or innocence is subjected to the same serious examination as the unconscious biases and prejudices each juror brings with them. Those assumptions must be brought into the open, challenged against the perceptions of their fellow equals, and continually tested against the reality before them.
